The applicant, by not submitting a detailed noise assessment, has failed to demonstrate that the refrigeration units on the roof of the building would not cause undue noise and disturbance to nearby residents. It is therefore not possible to properly assess the proposal in terms of the need for mitigation measures which might reduce existing harm from their operation. In the absence of this information, it is considered that the proposal would fail to accord with Policy CS2 of the Charnwood Local Plan (2011-2028) Core Strategy and Policy EV/1 of the Borough of Charnwood Local Plan.

It is the opinion of the local planning authority that the proposed fencing would, by virtue of its height and position be visually incongruous in the street scene and would be detrimental to the character and appearance of the area. The fencing would be adjacent to dwellings with principal windows and small garden areas and the proposed boundary treatment, in its elevated position would likely give rise to overshadowing and would have an overbearing impact on the residential amenities of existing occupiers. The proposal is therefore considered to be contrary to policy CS2 of the Charnwood Core Strategy, Saved Policy EV/1 of the Borough of Charnwood Local Plan and the objectives of the National Planning Policy Framework which seek to secure high quality design in developments and which respect their context.
