The proposed new access, by reason of siting, form, use of materials and overall appearance, would result in an incongruous form of development that would fail to relate to, and, would be out of keeping with with the character and appearance of the area and neighbouring buildings. In addition, it is considered that the proposal would not enhance or preserve the significance of the Mountsorrel Conservation Area or preserve the setting of the host dwelling as a Listed Building; instead it would result in less than substantial harm to the Conservation Area. There are no public benefits which would outweigh this harm caused. The proposal is therefore considered to be contrary to sections 66 & 72 of the Town and Country Planning (Listed Building and Conservation Areas) Act 1990 and the relevant provisions of Policies CS2 and CS14 of the Charnwood Local Plan (Core Strategy) and "saved" Policies EV/1 and H/17 of the Charnwood Local Plan 2004. Furthermore, the proposal will be contrary with the relevant provisions of paragraphs 189 to 196 of the National Planning Policy Framework.
