It is the opinion of the local planning authority that the proposal, by reason of the siting, design and materials of the proposed dwelling and its close relationship with the protected Copper Beech tree and the removal, realignment, reduced height and penetration of the boundary wall fronting Shooting Close Lane which provides an important sense of enclosure to this jitty, would be harmful to the visual amenity of the area and to the character and appearance of both the designated heritage asset (the Conservation Area) and the non-designated heritage asset (Shooting Close Lane). The proposal would lead to less than substantial harm to the significance of the designated heritage asset. In such cases, Paragraph 196 of the National Planning Policy Framework advises that permission should be refused unless it can be demonstrated that the harm is necessary to achieve public benefit that would outweigh that harm. The proposal is not considered to have such benefits. For these reasons, the scheme would be contrary to Policies CS2, CS14 and CS25 of the Charnwood Local Plan 2011-2028 Core Strategy, saved Policy EV/1 of the adopted Borough of Charnwood Local Plan, Policies BuS3 and Bus4 of the Barrow-upon-Soar Neighbourhood Plan, the Council's adopted Design Supplement Planning Document (January 2020), the Barrow-upon-Soar Village Design Statement (2016), the Barrow-upon-Soar Conservation Area Character Appraisal, the National Planning Policy Framework and the National Design Guide. It would also be contrary to the statutory requirements of the Planning (Listed Building and Conservation) Act 1990.
