The development has not been provided in accordance with the approved scheme or in accordance with the conditions imposed by the Planning Inspector. The proposal level of off street car parking is inadequate and the level of visibility splays out of the access is inadequate. The development as provided is therefore likely to lead to an additional demand for on street car parking to the detriment of highway safety. Vehicles leaving the site would also be a source of danger for highway users and in particular pedestrians due to the lack of suitable visibility splays.

Policy CS2 of the Charnwood Local Plan 2011-2028 Core Strategy and saved Policy EV/1 of the Borough of Charnwood Local Plan indicates that housing development should be of high quality. The design of the constructed dwelling does not result in a satisfactory form of development. In particular, the scheme would not meet the principle set out in Policy CS2 that new housing should, "make a positive contribution to Charnwood , resulting in places where people would wish to live through high quality, inclusive design, and where appropriate, architectural excellence. Proposals should respond positively to their context and reinforce a sense of place." The design of the dwelling as built has a vertical emphasis, accentuating its increased height and the lack of private amenity space has led to a poor standard of accommodation for potential occupiers. The detailing applied to the front elevation ground and first floor fenestration has led to an illegible and incongruous front elevation in the street scene which is considered to be inappropriate. The proposal is therefore contrary to policies of the development plan and would conflict with the objectives of these policies and central government advice, notably in the National Planning Policy Framework.
