Reasons 1

In the opinion of the Local Planning Authority, the proposal would be detrimental to the residential amenities of the occupiers of the neighbouring property at no.214 Humberstone Lane. Policy CS2 of the adopted Charnwood Local Plan Core Strategy and saved policies EV/1 and H/17 of the Borough of Charnwood Local Plan are relevant to the proposal, as is the Borough Council's supplementary planning guidance House Extensions. These policies seek to ensure that extensions to dwellings protect the amenities of people who live nearby, by not overshadowing or having an overbearing impact on neighbouring properties. By virtue of its scale and its proximity to no.214 Humberstone Lane and the breach of the 45 degree lines, it is considered that the proposed extension would overshadow and have an overbearing impact on a habitable room in that property. As such, it is concluded that the proposal is contrary to the policies and guidance mentioned above.


Reasons 2

The proposal is also considered detrimental to the residential amenities of the neighbouring property to the rear at no.15 Colby Drive as the proposed rear first floor window would directly overlook this neighbouring property and private garden area, and would not comply with the guidance on space standards for residential development set out in appendix 4 of the Council's 'Leading in Design' Supplementary Planning Document. As such, the proposal is contrary to Policy CS2 of the Charnwood Core Strategy and saved policies EV/1 and H/17 of the Borough of Charnwood Local Plan.
