The local planning authority is of the opinion that the proposed hot food takeaway, by reason of increased potential nuisance from the noise and disturbance generated from the premises by visiting customers, particularly during the late evenings when nearby residents have a reasonable expectation for a reduction in activity around the site, would be detrimental to the general residential amenities of those properties. The proposal would, therefore, be contrary to saved Policies EV/39 and CA/9 of the Borough of Charnwood Local Plan (2004) and Policy CS 2 of the emerging Charnwood Local Plan Core Strategy 2006 to 2028.

The short term parking requirements for customers of the proposed takeaway use is likely to lead to indiscriminate car parking within the highway, to the detriment of highway safety, due to the location of the premises and the limited availability of on-street parking. The proposal would therefore lead to increased dangers for highway users including pedestrians to the detriment of highway safety and contrary to saved Policy TR/6 of the Borough of Charnwood Local Plan (2004) and Policy CS 2 of the emerging Charnwood Local Plan Core Strategy 2006 to 2028.
