The local planning authority is of the opinion that the proposed extension to the nursery garden would be likely to be detrimental to the amenities of the occupiers of nearby residential properties, in particular No 11 Limehurst Avenue, due to the noise and disturbance caused by the playing of children in the rear garden. Furthermore the proposal would result in the loss of amenity to No 9 Limehurst Avenue in terms of the resulting garden being too small and cramped and it being in close proximity to noise and disturbance from the playing of children. The proposal would therefore be contrary to policies EV/1 and EV/39 of the Borough of Charnwood Local Plan and policy CS/2 of the Emerging Core Strategy which all seek to protect residential amenity.
