Reasons 1

It is the opinion of the local planning authority that in view of the position of the flue serving the restaurant at ground floor, to the rear of the premises, which would be in close proximity to the windows of the first floor apartments, it would result in poor living environment standards for future occupiers. The flue terminates below the eaves height of the building which would impede the dilution and dispersal of residual emissions and result in an unacceptable level of noise and disturbance to the apartments. The proposal is therefore contrary to policy EV/1, EV/39 of the Borough of Charnwood Local Plan and policy CS/2 of the Emerging Core Strategy which all seek to protect the amenity of future occupants of the development.
