Reasons 1

The application site lies within a Primarily Residential Area and the condition which this proposal seeks to vary was originally imposed to protect the amenity of nearby residents. The variation of condition 3 to allow the additional opening of the premises between 1700 and 2200 hours on Sundays, would result in unacceptable harm to the residential amenity of surrounding residential properties, due to an increase in noise, particularly at night time when residents can reasonably expect a level of tranquillity and when ambient noise levels are lowest. The proposal would therefore be contrary to Policy CS2 of the Charnwood Local Plan (2011-2028) Core Strategy and Saved Policy EV/1 of the Borough of Charnwood Local Plan, Policy DS5 of the Draft Charnwood Local Plan (2021-2037) and national advice within the Framework and National Planning Practice Guidance. It is considered the economic benefits of the proposal would not outweigh the environmental and social harm that would arise, which therefore constitutes an unsustainable form of development contrary to Policy CS 25 of the Core Strategy and the National Planning Policy Framework.
