The proposed development, by reason of siting and orientation, scale, massing, height and overall appearance, would result in the significant loss of access to sun light to the rear elevation of No. 5 Deacon Close, which contains habitable room windows at both ground and first floor level. This would be detrimental to the amenities of the occupants of this neighbouring property. In addition, the proposed development, by reason of siting, scale, massing, height and overall appearance, would result in an overbearing form of development in context of the neighbouring residential properties, No.'s 5 and 7 Deacon Close, private amenity spaces. Furthermore, the proposed development by virtue of the dormer window to be installed to the rear elevation of No. 6 Deacon Close at second floor level, would be detrimental to the amenities of the occupants to the neighbouring properties (No.'s 5 and 7) by reason of overlooking, both real and perceived, and consequent loss of privacy. Accordingly, the proposed development would be contrary with the relevant provisions of Policy CS2 of the Charnwood Local Plan (Core Strategy) and "Saved" Policies EV/1 and H/17 of the Charnwood Local Plan 2004. Furthermore, it is considered that the proposed development would be contrary with the relevant provisions of Paragraph 127 of the National Planning Policy Framework.
