The condition which this proposal seeks to vary was originally imposed to protect the amenity of nearby residents. Having regard to the lack of information accompanying the application to enable an assessment of whether the protection of residential amenity can be maintained as a result of proposed extended hours of operation, the local planning authority is not satisfied that the proposal would not result in harm to residential amenity in terms of noise and nuisance which would be contrary to the National Planning Policy Framework, Policy CS2 of the Charnwood Local Plan 2011-2028 Core Strategy and saved Policy EV/1 of the adopted Borough of Charnwood Local Plan.
