Reasons 1

The insertion of first floor windows in the rear elevations of the dwellings would give rise to an unacceptable level of close over-looking and therefore a loss of privacy to the occupants of the dwelling to the rear, No.2 The Old Glebe, which would be severely detrimental to residential amenity of the residents. This would be in conflict with the provisions of the adopted Leading in Design Supplementary Planning Document, the guidance given in the adopted Supplementary Guidance on Backland and Tandem Development and the purpose of the relevant restrictive condition imposed on the development of the dwellings. The condition was imposed to maintain reasonable levels of privacy for the occupiers of No.2 The Old Glebe, and, it is the opinion of the local planning authority that the development would result in an unacceptable loss of privacy to this property. The development would therefore be in conflict with adopted policy CS2 of the Charnwood Core Strategy 2028-2028 Local Plan, saved policy EV/1 of the Borough of Charnwood Local Plan, the provisions of the adopted Leading in Design Supplementary Planning Document, the guidance set out in the Backland and Tandem Development Supplementary Planning Guidance and the National Planning Policy Framework.
