2. The local planning authority is of the view that, notwithstanding the steps shown to mitigate the impact of the proposed floodlights, the low level of lighting in this part of the campus means that the lights, when they are in use, would be unduly intrusive when viewed from the direction of Spinney Hill Drive properties and would cause an unacceptable degree of light spillage onto the elevations of those dwellings, causing unwarranted disturbance and loss of general amenity. The local planning authority is not satisfied that the impact of the spillage of light, and the consequent harm to residential amenity, could be sufficiently and effectively mitigated by the imposition of conditions that would meet the tests set out in Circular 11/95. As such, the proposal is contrary to the guidance in paragraph 20 of PPG17, and to the intentions of saved policy EV/40 of the adopted Borough of Charnwood Local plan.


Reasons 1

1.The local planning authority is of the opinion, having weighed the evidence placed before it, that the use of the multi use games area would, by virtue of the level of noise generated, the nature and character of that noise, the change in the level of noise currently experienced in the immediate vicinity and the hours of use applied for, be likely to be seriously detrimental to the health and general amenities of nearby residents on Spinney Hill Drive. The local planning authority is not satisfied that the impact of noise, and the consequent harm to residential amenity, could be sufficiently and effectively mitigated by the imposition of conditions that would meet the tests set out in Circular 11/95. As such, the proposal is contrary to national planning guidance, as set out in paragraph 20 of Planning Policy Guidance 17 and paragraphs 10 and 11 of Planning Policy Guidance 24, and to the intentions of saved Policy EV/39 of the adopted Borough of Charnwood Local Plan.
