Reasons 1

The siting of the single storey extension to the side of the dwelling, with the installation of drainage in close proximity to the nearby Oak tree, which is the subject of the tree preservation order, would have a detrimental effect on the root system of the tree and also require the removal of branches. Insufficient details are provided to demonstrate that the proposals would not be damaging to the rooting system and canopy of the protected tree. It is the opinion of the local planning authority that the potential loss of the tree would be detrimental to the character and appearance of the area therefore, contrary to saved Policies H/17 and EV/1 of the Borough of Charnwood Local Plan (adopted 12th January 2004) and confirmed by the findings of the Planning Inspector in respect of the felling of the Oak tree appeal ref. APP/TPO/X2410/937.


Reasons 2

The local authority considers that, due to the form and design of the proposed 2.5 storey extension, by its increased eaves height and the resultant form of the low pitched roof, would appear as an incongruous feature in the streetscene, to the detriment of its appearance and character. Furthermore, the proposals include a third floor window in side gable, it is considered that by reason of location of the window in relation to 32 The Firs would result in overlooking of that property to the detriment of residential amenity. As such, it would be contrary to the intentions of saved Policies H/17 and EV/1 of the Borough of Charnwood Local Plan (adopted 12th January 2004) and the Council's adopted Supplementary Planning Guidance on House Extensions which seeks to ensure that extensions to dwellings are compatible with the host building and not incongruous in the wider area without injury to neighbouring residential amenity.
