The siting of the extension to the side of the dwelling, with the installation of drainage in close proximity to the Oak tree and involving the removal of branches of the tree, which is the subject of the tree preservation order. Based on the submitted information, insufficient details are provided to demonstrate that the proposals would not be damaging to the rooting system and canopy of the protected tree. It is the opinion of the local planning authority that the potential loss of the tree would be detrimental to the character and appearance of the area therefore, contrary to saved Policies H/17 and EV/1 of the Borough of Charnwood Local Plan (adopted 12th January 2004) and confirmed by the findings of the Planning Inspector in respect of the felling of the Oak tree appeal ref. APP/TPO/X2410/937.
