The siting of the extension to the side of the dwelling would have a detrimental effect on the root system of the nearby Oak tree, which is the subject of the tree preservation order, and also require the removal of branches of the tree. The proposals are likely to result in the loss of the Oak tree. It is the opinion of the local planning authority that the loss of the tree would be detrimental to the character and appearance of the area therefore, contrary to saved Policies H/17 and EV/1 of the Borough of Charnwood Local Plan (adopted 12th January 2004).
