The site, to which this application relates, falls within a Local Centre, as defined by the adopted Borough of Charnwood Local Plan. There are already four hot and cold food takeaway shops located within this small local shopping area. A further takeaway would result in an unacceptable concentration of food and drink (A5) uses, which would prejudice the viability and attractiveness of this local centre. For this reason the proposal would be contrary to Policy CA/9 of the Borough of Charnwood Local Plan (adopted 12th January 2004).

The local planning authority is of the opinion that the proposed use, by reason of additional noise and other disturbance generated by visiting customers during unsociable hours, would be detrimental to the residential amenities of the occupiers of the flat directly above these premises. For this reason, the proposal would be contrary to Policy EV/39 of the Borough of Charnwood Local Plan (adopted 12th January 2004).
