Reasons 1

It is established planning policy, at both national and local level, that new development should be permitted outside established settlements in exceptional circumstances only. These circumstances normally relate to an agricultural need. The proposed residential accommodation is located in the countryside and the local planning authority considers that there are no exceptional circumstances, including those associated with the mixed equestrian/agricultural use, which justify over-riding the normal planning policies. No evidence has been provided to demonstrate that the functional and financial tests to be applied in relation to this rural-based enterprise, as set out in Annex A to PPS7, have been met. As such the proposed development would conflict with the national guidance set out in PPS7 (Sustainable Development in Rural Areas), Strategy Policy 8 of the Leicestershire, Leicester and Rutland Structure Plan and Policies ST/2, CT/1 and CT/2 of the adopted Borough of Charnwood Local Plan which promote sustainable development and seek to protect the rural character and appearance of the countryside. Note to applicant: You are advised that this refusal of planning permission means that the present use of the premises as residential accomodation remains unauthorised and that, as such, it is at risk of being the subject of enforcement action by the local planning authority, which would be taken to secure the cessation of the unauthorised use. You are advised to arrange for the cessation of the use as soon as possible, to avoid the need for such action to be taken.
